Terms of Use

The terms that apply when you use towntime.au or the Towntime app. Last updated 11 August 2026.

1. About these terms

These Terms of Use ("Terms") are an agreement between you and Control Shift Co Pty Ltd (ABN 21 689 356 090) ("Towntime", "we", "us", or "our") and govern your use of the Towntime website at towntime.au (the "Website") and the Towntime mobile application (the "App") — together, the "Services". By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Our Privacy Policy explains how we handle your information and forms part of these Terms.

These Terms were last updated on 11 August 2026.

2. Age requirement

The Services feature specials and promotions at licensed venues, including drink specials. You must be at least 18 years old to use the Services. By using the Services, you confirm that you are 18 or older.

Please enjoy licensed venues responsibly. Nothing in the Services is intended to encourage excessive or irresponsible consumption of alcohol.

3. The service

Towntime provides information about venues, happy hours, specials, and events. This information is collected from public sources, venues, and community submissions, and is provided for general information only.

Specials and venue details can change without notice, and we do not guarantee that any listing is accurate, complete, or current. Always confirm details, including prices, times, and availability, with the venue before relying on them.

Towntime is an independent guide. Unless we expressly say otherwise, we are not affiliated with, endorsed by, or acting on behalf of any venue listed in the Services, and we are not the supplier of any goods or services offered by venues. Any purchase you make at a venue is between you and that venue.

4. Your licence to use the Services

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services for your own personal, non-commercial purposes in accordance with these Terms. All intellectual property rights in the Services and their content (other than content you submit) are owned by or licensed to us, and all rights not expressly granted are reserved.

5. Acceptable use

When using the Services, you must not: use them for any unlawful purpose or in breach of any applicable law; submit content that is false, misleading, defamatory, offensive, or that infringes anyone's rights; attempt to gain unauthorised access to the Services, our servers, or associated systems; interfere with or disrupt the Services, including by circumventing rate limits or security measures; scrape, harvest, or systematically extract data from the Services, or use automated tools to access them, without our written permission; or copy, resell, or commercially exploit the Services or their content.

We may suspend or restrict your access to the Services if we reasonably believe you have breached these Terms.

6. Content you submit

The Services let you submit content, such as special suggestions, reports about listings, and feedback ("User Content"). You are responsible for your User Content, including its accuracy and appropriateness, and you must have the right to share it.

You grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to use, store, display, reproduce, modify, and distribute your User Content for the purposes of operating, developing, promoting, and improving Towntime. This licence continues even where content has been incorporated into our listings, since submitted corrections and specials become part of the guide.

We may review, edit, decline, or remove any User Content at our discretion, including where we believe it is inaccurate or breaches these Terms. We are not obliged to publish any submission.

7. Location features and notifications (App)

Location-based features, including “Check near me” and Nearby Alerts, depend on your device's sensors, permissions, and connectivity, and may be inaccurate, delayed, or unavailable. Notifications may not always arrive or be timely. Do not interact with the Services while driving or in any situation that requires your attention.

8. Third-party services and links

The Services use third-party services, such as Google Maps, and may contain links to third-party websites or services, including venue pages and social media. We do not control and are not responsible for the content, availability, or privacy practices of third parties. Your use of third-party services may be subject to their own terms.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

Where our liability for breach of a non-excludable guarantee can be limited, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.

10. Disclaimer and limitation of liability

Subject to section 9, the Services are provided on an "as is" and "as available" basis, and we do not warrant that the Services will be uninterrupted, error-free, or that any information in them is accurate, complete, or current.

Subject to section 9 and to the maximum extent permitted by law, we exclude all liability for any loss or damage, whether direct, indirect, incidental, or consequential, arising out of or in connection with your use of, or inability to use, the Services, including any reliance on information in the Services or any dealings you have with a venue.

11. Indemnity

To the extent permitted by law, you indemnify us against any loss, damage, or expense (including reasonable legal costs) that we suffer arising from your breach of these Terms or your unlawful use of the Services, except to the extent we caused or contributed to that loss.

12. Changes to the Services and these Terms

We may change, suspend, or discontinue all or part of the Services at any time, including features, listings, and availability.

We may update these Terms from time to time. If we make changes, we will make the revised Terms available on this page and in the App and update the “last updated” date above. If a change is significant, we will take reasonable steps to bring it to your attention. Your continued use of the Services after revised Terms are made available constitutes your acceptance of them. If you do not agree to the revised Terms, you should stop using the Services.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time if we reasonably believe you have breached these Terms or where we discontinue the Services. Sections that by their nature should survive termination, including sections 6, 9, 10, 11, and 15, continue to apply.

14. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us in relation to the Services. If any provision of these Terms is found to be invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. A failure by us to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a restructure or sale of Towntime.

15. Governing law

These Terms are governed by the laws of Tasmania, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Tasmania and the courts entitled to hear appeals from them. Nothing in this section limits any rights you may have to bring proceedings in another forum under applicable consumer protection law.
